Becoming A Licensed Resource-Based Tourism Establishment

Amendments to Regulation 1037 of the Tourism Act

The Tourism Act and its associated Regulation 1037 mandate the licensing of only resource-based tourism accommodation establishments that receive specific Crown land and/or natural resource allocations from the Ministry of Natural Resources.

The Tourism Act and Regulation 1037 are administered province-wide by the Ministry of Tourism.

Who is Required to Hold a Resource-Based Tourism Establishment License?

Amendments to Regulation 1037 made in early 2007 specify that resource-based tourism accommodation establishments require a license only if they receive one or more of the following from the Ministry of Natural Resources:

i) under the Public Lands Act, a right to or an interest in public lands, as defined in that Act, for the purposes of providing sleeping accommodation for the traveling public or sleeping accommodation for the use of the public engaging in recreational activities,

ii) the consent of the Minister of Natural Resources under the Public Lands Act to store a boat for commercial tourism purposes,

iii) on behalf of their registered guests, a moose validation tag issued under the Fish and Wildlife Conservation Act, 1997, or

iv) a licence issued to provide black bear hunting services under the authority of the Fish and Wildlife Conservation Act, 1997.
